What is the nature of the texts examined by the Legislation Section ?The Legislation Section advises on texts containing a norm, i.e. a rule imposing provisions relating to an injunction or a prohibition which are applicable to all citizens, or certain categories thereof, or grant advantages to them. This concerns, on the one hand, drafts of law prepared by an Administration or a Ministerial Cabinet and which, after their approval by the competent Government, will need to be examined and voted by the competent Legislative Assembly (Assemblies). The Council of State may also be asked to give an opinion on drafts of law, Decree or Ordinance, i.e. texts prepared by a member of a Parliamentary Assembly and tabled with the Assembly he is a member of, as well as on amendments to drafts of law. This concerns, on the other hand, draft regulations originating from the executive power (Governments) and containing a norm implementing legal texts. |
