Rvs-Cde  Council of State

Task of the Administrative Litigation Section

The chambers of the Administrative Litigation Section pronounce judgments and issue orders.

Judgments

The Council of State pronounces judgment on the legality of administrative acts. It has the jurisdiction to annul acts which are contrary to the law rules in force and to suspend their enforcement in case of emergency.

Orders on the admissibility of an appeal in cassation

The Council of State also rules on the appeals in cassation against decisions of the administrative jurisdictions. A ruling on those appeals can only be given if they have been declared admissible by an order. The proceedings come to an end if the appeal in cassation is declared inadmissible by the order.
