What happens in case of failure to consult the Legislation Section?Regulatory decrees may be contested before the Council of State's Administrative Litigation Section through an action for suspension or an action for annulment for failure to comply with the consultation obligation. The application of Section 159 of the Constitution (FR - NL) may be relied on in courts. The decree is regarded as unlawful and therefore inapplicable because it has been deemed contrary to the law. |
