Statement in reply – explanatory statement

The Registry notifies the statement in response to the applicant. As from that notification, the applicant has sixty days at his disposal to send a statement in reply. This statement’s main objective is to reply to the defence of the authority. Apart from that, it may only include further explanations concerning the application, if, for instance, new data would have come to light after lodging the application. Even if the opposing party would have failed to send a statement in response, the applicant will be nonetheless asked to send in an explanatory statement. If no statement of reply or explanatory statement is sent in within the prescribed time limit, the applicant will be deemed to have no longer the required interest in the case and his appeal will be dismissed.
